It allows a child in this situation to live permanently with their sponsoring relative in Australia.<\/p>\n<p>The sponsoring relative usually applies on behalf of the child. The child must be inside Australia when the application is lodged and when the application is decided.<\/p>\n<p><strong>Eligibility:<\/strong><\/p>\n<p>To apply for this visa, a child must:<\/p>\n<ul>\n<li>Be in Australia<\/li>\n<li>Be younger than 18 years old<\/li>\n<li>Be sponsored by their relative who is:\n<ol>\n<li>The brother, sister, grandparent, aunt, uncle or step-equivalent of the child<\/li>\n<li>Older than 18 years of age<\/li>\n<li>An Australian citizen, an Australian permanent resident or an eligible New Zealand citizen<\/li>\n<\/ol>\n<\/li>\n<li>Not be married or in a de-facto relationship<\/li>\n<li>Be in situation where their parents are unable to care for them<\/li>\n<li>Meet health and character requirements.<\/li>\n<\/ul>\n<p><strong>What does this visa allow for:\u00a0<\/strong><\/p>\n<p>This is a permanent residence visa. It allows the child to:<\/p>\n<ul>\n<li>Stay in Australia indefinitely<\/li>\n<li>Work and study in Australia<\/li>\n<li>Enroll in Medicare, Australia\u2019s scheme for health-related care and expenses<\/li>\n<li>Apply for Australian citizenship (if they are eligible)<\/li>\n<li>Sponsor eligible relatives for permanent residence<\/li>\n<li>Travel to and from Australia for five years from the date the visa is granted \u2013 after that time they will need another visa to enter Australia.<\/li>\n<\/ul>\n<div id=\"sub-heading-1\" class=\"content-block\">\n<p><strong>Costs:<\/strong><\/p>\n<p>The visa application charges are listed in\u00a0<a href=\"#\" target=\"_blank\" rel=\"noopener noreferrer\">Fees and charges<\/a>.<\/p>\n<p>An individual might have to pay other costs, such as the costs of health assessments, police certificates, or any other certificates or tests. They are responsible for making the necessary arrangements.<\/p>\n<\/div>\n<p><strong>The child\u2019s parents:<\/strong><\/p>\n<p>A child is eligible for this visa if their parents are not able to care for them. This could be because the parents:<\/p>\n<ul>\n<li>Are dead<\/li>\n<li>Are incapable of caring for the child<\/li>\n<li>Cannot be found.<\/li>\n<\/ul>\n<p>A child cannot apply for this visa if their parents could care for them but do not want to.<\/p>\n<p>If the parents cannot be found, the application will need to show how long they have been missing and what has been done to try to find them.<\/p>\n<p><strong>Parental responsibility:<\/strong><\/p>\n<p>This visa can be granted only if the individual can show one of the following for a child younger than 18 years of age:<\/p>\n<ul>\n<li>They have the written consent of each person who can legally decide where the child lives<\/li>\n<li>The laws of the child\u2019s home country\u00a0permit the removal of the child<\/li>\n<li>It is consistent with any Australian child order.<\/li>\n<\/ul>\n<p>This visa will not usually be granted if it is against the best interests of a child younger than 18 years of age.<\/p>\n<p><strong>Assurance of support:<\/strong><\/p>\n<p>An assurance of support might be asked for the child so that welfare costs for some migrants are not borne by the Australian community.<\/p>\n<p>Do not provide an assurance of support unless asked for.<\/p>\n<h4><strong>When a child might not be eligible for this visa:<\/strong><\/h4>\n<p>A child might not be able to apply for this visa if they are already in Australia and either they or their sponsoring relative:<\/p>\n<ul>\n<li>Do not currently hold a substantive visa<\/li>\n<li>Have not applied for the child to get an Orphan Relative visa within twelve months of their previous substantive visa ceasing.<\/li>\n<\/ul>\n<p>A child whose parents simply do not want to care for the child cannot apply for this visa.
