{"id":8852,"date":"2025-05-28T12:50:41","date_gmt":"2025-05-28T12:50:41","guid":{"rendered":"https:\/\/webtechnomind.in\/work\/global-vision-Immigration\/?page_id=8852"},"modified":"2025-05-28T12:50:41","modified_gmt":"2025-05-28T12:50:41","slug":"nb-business-immigration-stream","status":"publish","type":"page","link":"https:\/\/webtechnomind.in\/work\/global-vision-Immigration\/nb-business-immigration-stream\/","title":{"rendered":"NB Business Immigration Stream"},"content":{"rendered":"<h1><span style=\"color: #000000;\"><span style=\"font-size: 14pt;\"><strong>NB Business Immigration Stream<\/strong><\/span><strong><span style=\"font-size: 14pt;\"><br class=\"none\" \/><\/span><\/strong><\/span><\/h1>\n<p><span style=\"color: #000000;\">The NB Business Immigration stream helps applicants to buy\/set up and run a business in New Brunswick (NB).<\/span><\/p>\n<h2><span style=\"color: #000000; font-size: 14pt;\"><strong><br class=\"none\" \/>Who can apply to the NB Business Immigration Stream of NB PNP?<\/strong><\/span><\/h2>\n<p><span style=\"color: #000000;\">To apply to the NB Business Immigration stream, meet the following terms:<\/span><\/p>\n<h3><span style=\"font-size: 12pt; color: #000000;\"><strong><br class=\"none\" \/>Business terms<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">The business must be:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">Firstly, beneficial to the economy of the province.<\/span><\/li>\n<li><span style=\"color: #000000;\">Secondly, registered and set as a sole proprietorship, partnership, or corporation<\/span>\n<ul>\n<li><span style=\"color: #000000;\">But in the case of a partnership, other partner(s) must be a permanent resident(s) or a Canadian citizen(s).<\/span><\/li>\n<\/ul>\n<\/li>\n<li><span style=\"color: #000000;\">Either is running as an established business or a new business has been set up.<\/span><\/li>\n<li><span style=\"color: #000000;\">Also, is setup\/running as a for-profit entity to get revenue through the sale of goods and\/or services.<\/span><\/li>\n<li><span style=\"color: #000000;\">Finally, is a permanent settlement as defined under subsection 400(2) of the Canadian Income Tax Regulations, 1985.<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-size: 12pt; color: #000000;\"><strong><br class=\"none\" \/>Economic Benefit<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">NB PNP may\u00a0fast track the processing\u00a0of those applications whose business plans will benefit NB greatly. Also, these business plans can give economic benefits through the following:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">Increase value-added manufacturing or processing for NB exports.<\/span><\/li>\n<li><span style=\"color: #000000;\">Growth\u00a0in research and development.<\/span><\/li>\n<li><span style=\"color: #000000;\">Develop new products\u00a0and or services.<\/span><\/li>\n<li><span style=\"color: #000000;\">Developing an innovative approach towards traditional businesses.<\/span><\/li>\n<li><span style=\"color: #000000;\">Enhancement\/development of new technologies.<\/span><\/li>\n<li><span style=\"color: #000000;\">Offering NB, the transfer of technology and specialised knowledge to its people.<\/span><\/li>\n<li><span style=\"color: #000000;\">Giving\u00a0products and\/or services to an under-served local or regional market.<\/span><\/li>\n<li><span style=\"color: #000000;\">Identification of immediate needs in specific regions or communities; and<\/span><\/li>\n<li><span style=\"color: #000000;\">Others, as identified by PETL.<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-size: 12pt; color: #000000;\"><strong><br class=\"none\" \/>Investment<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">At the time of investing in a business, you must\u00a0do the following:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">Firstly, make a minimum investment of CAD $150,000 before tax.<\/span><\/li>\n<li><span style=\"color: #000000;\">Secondly, have a minimum of 33% equity in the business.<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-size: 12pt; color: #000000;\"><strong><br class=\"none\" \/>Buying an existing NB business<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">In case of buying an existing business, you must prove to PETL that the business meets terms such as:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">Has been running under the same owner for the past 3 years. Also, the owner must be a permanent resident or Canadian citizen.<\/span><\/li>\n<li><span style=\"color: #000000;\">Will be bought at a market value and a fair price.<\/span><\/li>\n<li><span style=\"color: #000000;\">As per audited financial statements, and corporate tax assessments the business has been earning a net profit for at least 2 years in 3 years.<\/span><\/li>\n<li><span style=\"color: #000000;\">Will continue to employ existing staff as per earlier terms and conditions.<\/span><\/li>\n<li><span style=\"color: #000000;\">Before the purchase date, the business is not in receivership and\/or has not filed for bankruptcy in the past 3 years, and<\/span><\/li>\n<li><span style=\"color: #000000;\">When buying a profitable business, the goodwill must not exceed 10% of the netbook value.<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-size: 12pt; color: #000000;\"><strong><br class=\"none\" \/>Job Creation in NB<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">The business must create 1 full-time, permanent, continuous, paid job position. Also, this position cannot be filled by the applicant, their spouse\/common-law partner, its dependent children and\/or other family members. Besides, a full-time job\u00a0means 30 hours of work per week.<\/span><\/p>\n<h3><span style=\"font-size: 12pt; color: #000000;\"><strong><br class=\"none\" \/>Running a business in NB<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">To run a business in the province, you must:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">Make sure the business pays all taxes on income earned in NB, irrespective of the taxes that are payable in other jurisdictions due to income received or any other business activity.<\/span><\/li>\n<li><span style=\"color: #000000;\">Abide by all legislation in NB, including but not limited to, the Employment Standards Act, Human Rights act, and Occupational and Health and Safety Act.<\/span><\/li>\n<li><span style=\"color: #000000;\">Follow all Canadian laws when it comes to buying, setting up, and running the business, and<\/span><\/li>\n<li><span style=\"color: #000000;\">Get all licenses\/permits from all applicable\u00a0municipal, provincial and\/or federal authorities.<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-size: 12pt; color: #000000;\"><strong><br class=\"none\" \/>Active managerial role in business<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">As per the NB Business Immigration stream, the applicant must be actively involved in the day-to-day operations of the business. So, as per the Immigration and Refugee Protection Regulations (IRPR), section 87(6) (c) you must do the following:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">Assess risk and direct the business.<\/span><\/li>\n<li><span style=\"color: #000000;\">Be actively involved in running the business.<\/span><\/li>\n<li><span style=\"color: #000000;\">Be present at the business premises daily.<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-size: 12pt; color: #000000;\"><strong><br class=\"none\" \/>Net worth verification report<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">If you get an ITA, you must submit a net worth verification report duly assessed by a PETL designated professional accounting service provider. Also, this report will share the:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">Total verifiable net worth.<\/span><\/li>\n<li><span style=\"color: #000000;\">Details of legally accumulated funds, and<\/span><\/li>\n<li><span style=\"color: #000000;\">The further requirement for investigation.<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-size: 12pt; color: #000000;\"><strong><br class=\"none\" \/>Presence in NB<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">While setting up your business:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">You must be living in NB for at least 75% of the duration of the Business Establishment Period,<\/span><\/li>\n<li><span style=\"color: #000000;\">And must be living within 100 km from the place of your business.<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-size: 12pt; color: #000000;\"><strong><br class=\"none\" \/>Site Visit<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">Before getting a nomination certificate, PETL will conduct research and interview at the site of business. Because they will check if the applicant meets all the terms and conditions of the signed Business Performance Agreement (BPA).<\/span><\/p>\n<h3><span style=\"font-size: 12pt; color: #000000;\"><strong><br class=\"none\" \/>Qualifying Seasonal Businesses<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">Under this factor, certain seasonal businesses qualify under the NB Business Immigrations stream.<\/span><\/p>\n<h3><span style=\"font-size: 12pt; color: #000000;\"><strong><br class=\"none\" \/>Agriculture (some businesses might qualify)<\/strong><\/span><\/h3>\n<ul>\n<li><span style=\"color: #000000;\">Business must be running for a minimum period of 9 months out of 12.<\/span><\/li>\n<li><span style=\"color: #000000;\">A minimum farm size of 100 hectares.<\/span><\/li>\n<li><span style=\"color: #000000;\">Agricultural business plans will be assessed and evaluated by an authority committee before an ITA is sent.<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-size: 12pt; color: #000000;\"><strong><br class=\"none\" \/>Tourism\u00a0(some businesses might qualify)<\/strong><\/span><\/h3>\n<ul>\n<li><span style=\"color: #000000;\">Minimum operating time must be a minimum of 9 months out of 12.<\/span><\/li>\n<li><span style=\"color: #000000;\">If the minimum equity is more than $ 1 million CAD, then the business must be running for a minimum period of 6 months out of 12.<\/span><\/li>\n<li><span style=\"color: #000000;\">Tourism\u00a0business plans will be assessed and evaluated by an authority committee\u00a0before an ITA is sent.<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-size: 12pt; color: #000000;\"><strong><br class=\"none\" \/>Key Sectors<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">The following list is extensive and PETL reserves all rights to modify the list as per its discretion:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">Manufacturing<\/span><\/li>\n<li><span style=\"color: #000000;\">Information and communication technology (ICT)<\/span><\/li>\n<li><span style=\"color: #000000;\">Cybersecurity<\/span><\/li>\n<li><span style=\"color: #000000;\">Value-added wood<\/span><\/li>\n<li><span style=\"color: #000000;\">Agriculture<\/span><\/li>\n<li><span style=\"color: #000000;\">Aquaculture<\/span><\/li>\n<li><span style=\"color: #000000;\">Tourism<\/span><\/li>\n<li><span style=\"color: #000000;\">Digital health<\/span><\/li>\n<li><span style=\"color: #000000;\">Food and beverage<\/span><\/li>\n<li><span style=\"color: #000000;\">Contact\/call centres<\/span><\/li>\n<li><span style=\"color: #000000;\">Energy innovation<\/span><\/li>\n<li><span style=\"color: #000000;\">Aerospace and defence<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-size: 12pt; color: #000000;\"><strong><br class=\"none\" \/>Ineligible Businesses<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">The following businesses do not qualify under the NB Business Immigration stream:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">Any business that offers or deals with explicit services, this refers to but is not limited to the creation, marketing, distribution, and\/or sale of pornography, or explicit products and\/or services, and\/or are providing erotic services.<\/span><\/li>\n<li><span style=\"color: #000000;\">Bed and breakfast accommodations.<\/span><\/li>\n<li><span style=\"color: #000000;\">Coin-operated occupations.<\/span><\/li>\n<li><span style=\"color: #000000;\">Consultancy (a business or agency that offer professional advice in a particular field).<\/span><\/li>\n<li><span style=\"color: #000000;\">Online language and educational training centres.<\/span><\/li>\n<li><span style=\"color: #000000;\">Settlement services \u2013 that\u00a0helps newcomers or temporary residents to settle.<\/span><\/li>\n<li><span style=\"color: #000000;\">Cooperative (business or organisation whose owners are its members)<\/span><\/li>\n<li><span style=\"color: #000000;\">Ecommerce or online businesses.<\/span><\/li>\n<li><span style=\"color: #000000;\">Domain names.<\/span><\/li>\n<li><span style=\"color: #000000;\">Hobby farm for personal use and does not\u00a0the main source of income.<\/span><\/li>\n<li><span style=\"color: #000000;\">Brokerage businesses (a business that gets income by being a middleman between the buyer and the seller.<\/span><\/li>\n<li><span style=\"color: #000000;\">Financial services including but not limited to cooperative, and\/or credit unions, short-term borrowing such as but not limited to a payday loan, cheque cashing, money changing and cash machines, cheque cashing, money changing and cash machines, pawnbrokers etc.<\/span><\/li>\n<li><span style=\"color: #000000;\">Any home-based business or any business that is running from a residential place.<\/span><\/li>\n<li><span style=\"color: #000000;\">Landlord property and rental management.<\/span><\/li>\n<li><span style=\"color: #000000;\">An inn or boutique that less than 5 rental units. And generates revenue less than CAD $100,000.<\/span><\/li>\n<li><span style=\"color: #000000;\">Not-for-profit businesses and organisations.<\/span><\/li>\n<li><span style=\"color: #000000;\">Property investment (purchase, construction, development of real state where the main aim is to get a return on investment\/rental\/money from the resale. But construction and\/or development may qualify if the applicant gives multiple signed contracts.<\/span>\n<ul>\n<li><span style=\"color: #000000;\">Besides, this does not include buying existing properties\/businesses.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><span style=\"color: #000000;\">Professional services\/practises where the applicant does not have proper licensing or cannot show proof of the same.<\/span><\/li>\n<li><span style=\"color: #000000;\">The business is an immigration-linked passive investment scheme\u00a0as per the\u00a0o Immigration and Refugee Protection Regulations section 87(5)b and as defined by IRPR 87(9).<\/span><\/li>\n<li><span style=\"color: #000000;\">Is running from a jurisdiction that is outside NB.<\/span><\/li>\n<li><span style=\"color: #000000;\">\u00a0Offers products and services that can be used seasonally. All businesses applying to the NB Business Immigration Stream must be running for 12 months regularly in a year except for certain businesses that\u00a0are\u00a0exempt from this term.<\/span><\/li>\n<li><span style=\"color: #000000;\">Promotion and\/or sale of illegal items and items that favour, support, inspire or promote people to do illegal activities such as but not limited to fake products, copies of movies, software, and trademark etc.<\/span><\/li>\n<li><span style=\"color: #000000;\">Promotion and\/or sale of a controlled substance and illegal drugs, prescription drugs and items, that are in use of making\u00a0controlled substances and\/or drug-related items, and<\/span><\/li>\n<li><span style=\"color: #000000;\">Any business which can bring harm to the NB, if they are associated with it.<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-size: 12pt; color: #000000;\"><strong><br class=\"none\" \/>Exploratory Visits<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">If an applicant wants to live in NB and set up a business, then they must visit the province to check the profitability of their business. Thus, they must conduct an exploratory visit for a minimum of 5 days excluding travel days, public holidays, and weekends. Besides, the applicant must submit a report of the visit along with their application.<\/span><\/p>\n<h3><span style=\"font-size: 12pt; color: #000000;\"><strong><br class=\"none\" \/>Agree to live in NB<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">All applicants must agree to live in NB if they get a nomination certificate.<\/span><\/p>\n<p><span style=\"color: #000000;\"><em><span style=\"text-decoration: underline;\"><strong><br class=\"none\" \/>To know about NB Business Immigration stream selection factors,<\/strong><\/span> <span style=\"color: #993300;\"><a style=\"color: #993300;\" href=\"https:\/\/web.archive.org\/web\/20230206073901\/https:\/\/gvimmigration.com\/nb-business-immigration-stream-selection-factors\/\"><span style=\"text-decoration: underline;\"><strong>click here<\/strong><\/span><\/a><\/span>.<\/em><\/span><\/p>\n<h2><span style=\"color: #000000;\"><strong><br class=\"none\" \/><\/strong><span style=\"font-size: 14pt;\"><strong>Who can not apply to the NB Business Immigration Stream?<\/strong><\/span><\/span><\/h2>\n<p><span style=\"color: #000000;\">An applicant can not apply to the NB Business Immigration stream because of the following:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">Have an active application registered with PETL before applying to this stream.<\/span><\/li>\n<li><span style=\"color: #000000;\">Already have a property\/business in any other province\/territory of Canada.<\/span><\/li>\n<li><span style=\"color: #000000;\">Your application is already under processing in any other province\/territory.<\/span><\/li>\n<li><span style=\"color: #000000;\">The application has been rejected earlier due to misrepresentation through any other immigration program.<\/span><\/li>\n<li><span style=\"color: #000000;\">Are living in Canada illegally.<\/span><\/li>\n<li><span style=\"color: #000000;\">Do not have permission to work in Canada.<\/span><\/li>\n<li><span style=\"color: #000000;\">Are living in Canada when you do not have the legal status to do so. Also, you have not applied for restoration of your legal status within 90 days of the expiration of legal status.<\/span><\/li>\n<li><span style=\"color: #000000;\">Have a failed or unresolved refugee claim or humanitarian and compassionate claim. Also, are currently living in Canada.<\/span><\/li>\n<li><span style=\"color: #000000;\">Are not legally living in the current country of your residence.<\/span><\/li>\n<li><span style=\"color: #000000;\">Are currently studying full-time in a post-secondary educational institution in Canada.<\/span><\/li>\n<li><span style=\"color: #000000;\">Have received a full-time, seasonal, or part-time or casual job in NB.<\/span><\/li>\n<li><span style=\"color: #000000;\">Are registered under the Live-in Caregiver Program of Canada.<\/span><\/li>\n<li><span style=\"color: #000000;\">Your personal net worth can not be verified by a third party; Or<\/span><\/li>\n<li><span style=\"color: #000000;\">You intend to be a passive investor.
